Published by: jane 2010-03-18
  • Entire definition of the DUI law in PA./ DUI conviction in pennsylvania...first, second and third dui charge what IS COMPLETE law covering this issue including all fines/'punishments'/revocations etc. along with any amendents made to law. Need same law text info for drving with suspended liscense while under a dui revocation/liscense suspension. Want what lawyers /judges police refer to and read (NOT drivers) to make their decisions and judgements in court and to mandate jail time, fines et al. LOOKING FOR ONE COMPLETE TEXT TO READ FOR THIS OR TO FIND THE SITE WHERE THIS CAN BE FOUND. Is there one place where all htis info exists and if not best way to get it.

  • Are you near any county capitals, courts, significant size towns, or colleges or universities? If so, which ones? I might be able to find you a law library in one of these places. (Or perhaps the DA in your county can point you to the best local library with legal material.) Librarians are trained to help people to find information on issues they want to learn about. In particular, law librarians can help you with research on legal issues.

  • Info requested is not available in any great detail online yet but I felt what was given was good for what was there to work with.

  • Hello anarchygirl-ga, At the outset, I should emphasize the disclaimer at the bottom of this page, which notes that answers and comments on Google Answers are general information, and not substitutes for professional legal advice. If you need complete and expert information on the DUI law, you should consult an attorney in Pennsylvania. I have found the text of the DUI law here: "Pennsylvania Consolidated Statutes - The Vehicle Code (Title 75) - Part III Operation of Vehicles - Chapter 37. Miscellaneous Provisions. - 3731. Driving under influence of alcohol or controlled substance." (last revised July 2000) Pennsylvania Consolidated Statutes / Unconsolidated Pennsylvania Statutes http://members.aol.com/StatutesPA/75PA3731.html There is also a provision on homicide by vehicle while DUI: "Pennsylvania Consolidated Statutes - The Vehicle Code (Title 75) - Part III Operation of Vehicles - Chapter 37. Miscellaneous Provisions. - 3735. Homicide by vehicle while driving under influence." (last revised July 2000) Pennsylvania Consolidated Statutes / Unconsolidated Pennsylvania Statutes http://members.aol.com/StatutesPA/75PA3735.html As both of these pages note: "The complete Pennsylvania Statutes are not yet available on the web. ... These statutes, though available instantaneously over the web, may not be the current law. Court decisions overturning them, later statutes amending them, and a host of other factors come into play when interpreting them. They are provided here as a resource. They should provide some information about the state of the law. However, a competent lawyer, who from other sources will research the law to insure what is current, should always be employed in matters of importance." If you want to check yourself on the text of these laws, you might want to visit a nearby law library and ask a law librarian for the text. If you cannot find a local law library, I would be happy to find one for you, if you can tell me your general location in Pennsylvania. I hope that this information is helpful. - justaskscott-ga Search terms used on Google: site:state.pa.us "under the influence" 3731 "person shall not drive" [I also checked on the Pennsylvania pages on FindLaw ( http://www.findlaw.com/11stategov/pa/laws.html ) and WashLaw ( http://www.washlaw.edu/uslaw/uslnd_tx.html#Pennsylvania ) to confirm that there were no other major statutory compilations online with this text.]

  • Hello Scott. Thanks for what you did find. Let me explain why I am looking for this info. even though I have an excellent attorney already who is well versed in current laws. I was railroaded through the court system with dui convictions even though I had no alcohol or illegal drugs in my system at all. I was on medication for an illness at the time and because I live in a "backwoods " rural area and the cops here are like Barney Fife on Mayberry R.F.D./ they assumed I was intoxicated because they were not familiar with the medication I was prescribed. This was a number of years ago when I did not have my current excellent attorney and was naive about the law. This has happned to me three times with these idiot cops ( it verges on harrasment as they would seek me out to find a reason to pull me over etc. but nothing I could prove as harrassment or I would have went with that.....) and as the liscense revocation for this is 7 (seven) years/repeat offender status it is ruining my career and my life, seeing that it is all bullshit and all happened in a one year period. Now I am no longer on this medication and healthy and my career is taking off big time, I was recently cited for driving (w/o liscense) while going to my business to work and as that is a 90 day JAIL sentence I have just had it! and I have been looking into ways of getting some of this overturned because it is so WRONG and unfair. I have been told by the head D.A. in my county that this is possible with the right information. So I am trying to find seldom known sub-stratas of the law/precedent/anomalys etc. to cite and use or research. You stated though, that none of this info. is online? Woudl a law library have this specific info? If you need more info. to help decide where my best sources lay let me know and thank you again. (I want to find out as much as I can besides the work/info. my attorney can provide ...you never know what you can dig up right?) CAt
